The terms and phrases listed below are to be intended as indicated, understood that singular forms shall also include plural ones and vice versa.
- Customer: any subject (natural or legal person) that purchases one or more Products on the online Shop, agreeing on the General Terms and Conditions.
- Sve.zia: S.r.l. with headquarters in Ello (LC), Viale Vittorio Veneto 4, VAT 03329960136.
- Parts: jointly Sve.zia S.r.l. and the Customers.
- General Terms and Conditions: current General Terms and Conditions and future ones that will be published on the online Shop.
- Online Shop: virtual shop run by Sve.zia S.r.l. where you can purchase Civi Solution Products.
- Sales and Purchase Agreements: Sales and Purchase contracts for the Finished Products, according to art. 3, between Sve.zia S.r.l. e and the Customers, on the online Shop of Civi Solution products.
- Orders: Orders of products sent by Customers, according to the General Terms and Conditions and following art. 6 procedure.
- Price: sale price of the Products as stated in the online Shop in correspondence with the Products themselves.
- Products: Products uploaded on the online Shop with sale purpose.
2.1 The General Terms and Conditions govern all Sale and Purchase Agreements and form an integral part thereof.
2.2 Sve.zia S.r.l. reserves the right to modify the General Conditions at any time, it being understood that the General Conditions that shall apply to the Sale and Purchase Agreements are the ones indicated on the online Shop at the time the Orders are placed by the Customers.
2.3 In case of conflict between the General Conditions and any other terms and conditions relating to the Sale and Purchase Agreements published on the online Shop, the terms and conditions more favourable to the Customers shall apply.
3. Conclusion of Sale and Purchase Agreements
3.1 Sve.zia S.r.l. undertakes to send the Order Confirmation to the Customers within 2 working days from the reception of the Orders by the Customers.
3.2 The Sale and Purchase Agreements between the Parties shall be considered concluded when the Customers receive the Order Confirmation. If the Customers do not receive the Order Confirmation within the term indicated under clause 3.1, the relevant Order shall be considered as rejected by Sve.zia S.r.l. and therefore ineffective.
3.3 By placing the Orders, the Customers declare to have read all the instructions concerning the purchase procedures of the Products as set forth under clause 6 and to have fully accepted the General Conditions as well as to have read all further information indicated on the online Shop, also recalled through links.
3.4 The Orders will be stored in the database of the online Shop, according to the modalities and in compliance with the provisions of D. Lgs. 30.06.2003 n. 196 (“Privacy”) and will be accessible by contacting Sve.zia S.r.l. at the references of art. 15.
4. Product Availability
4.1 The items offered for sale are generally available in stock. If individual products are out of stock, they are temporarily excluded from the online Shop.
However, in case single items illustrated on the site were not available for any reason, Sve.zia S.r.l. will exclude them from the order, keeping unchanged the other single items.
The Customer, by placing the order, agrees and accepts that only part of the goods can be sent, at the corresponding cost.
5. Price and shipping costs
5.1 The Price is expressed in € (Euro). The applicable Price is the one indicated on the online Shop at the time the Orders are placed by the Customers.
5.2 The Price is inclusive of VAT (22%).
5.3 The Price does not include shipping costs. Sve.zia S.r.l. reserves the right to request or not to request from the Customers a contribution for the shipping costs which may vary according to the type of delivery, the quantity of Products to be delivered, their volume, their weight and their destination.
5.4 The contribution to date required for shipping costs is indicated below in clause 8.2.
6. How to purchase
6.1 Placing your order is very simple!
- Browse the civisolution.com website
- Place the desired products in the virtual shopping basket by clicking the “Add to basket” button in the “Shop” section
- When you have selected the items, click on the “Proceed to checkout” button
- Enter the billing and shipping information. As soon as the purchase is completed, you will receive an e-mail with your personal access data.
Registration is simple, fast and secure.
By registering you can find out about new products and access special offers. You will receive informative or commercial messages by e-mail (newsletter). You can also manage your account and delivery addresses and easily view your orders. You can change your data at any time. Enter your shipping and payment information to complete your purchase.
- You will then receive an order confirmation by e-mail.
6.2 No minimum order!
You can buy as many items as you want, even one product, subject to availability.
6.3 Each order transmitted to Sve.zia S.r.l. is equivalent to a contractual proposal of the Customer therefore, it is binding for Sve.zia S.r.l. only if:
- It is complete in every part.
- It is confirmed and accepted by Sve.zia S.r.l. through the processing of the order itself. Sve.zia S.r.l. reserves the right not to accept incomplete orders or lacking the necessary data for their execution.
6.4 The fiscal documentation required by law will be issued by Sve.zia S.r.l. at the time of shipment to the Customer of the ordered products.
7. Payment methods
7.1 The purchase can be paid using the debit or credit cards listed below:
– VISA ELECTRON
– V PAY
– BANCOMAT PAY
Furthermore, Sve.zia srl declares that it does not have access to or record the complete data relating to the payment method used by the Customer. Only the agency processing the payment has access to this complete data for payment management purposes.
The amount of the order will be charged to the credit card after confirmation.
The data received by Sve.zia S.r.l. will be used exclusively for the processing of the sale of the products and for the refund modalities in case the customer exercises the right of withdrawal.
8. Shipping times and costs
8.1 All orders for which confirmation of payment is received on a working day, are processed within the next day. Orders received on Saturday and Sunday will be processed on Monday.
Shipments and deliveries will be handled throughout the Italian national territory, through the express courier BARTOLINI in indicative times from two to five working days.
The expenses of stock, that arise to the missed delivery of the order, will be debited to the Customer, in the cases in which the personal data are wrong, equivocal, lacking of fundamental parts that prevent the normal delivery.
In some periods of the year, deliveries may be slowed down as for example in the pre-Christmas period or before the holidays.
8.2 Shipping costs
For orders over € 199.00, Sve.zia S.r.l. will pay the transport costs and deliver the Civi Solution products free of charge.
For orders below € 199.00, the transport costs for the delivery of the Civi Solution products amount to € 6.90.
For all orders, the transport costs for the delivery of the Civi Solution products amount to € 15.90 .
Other EU countries
The transport costs are at the expense of the customer. Please contact us at email@example.com , so that we can inform you about the transport costs.
9. Right of withdrawal
9.1 If Customers are “Consumers” (i.e. a natural person acting for purposes unrelated to any entrepreneurial, commercial, handicraft or professional activity carried out), Customers are entitled, pursuant to and in accordance with art. 64 of Legislative Decree no. 206/2005, to withdraw from the Sale and Purchase Agreements within 30 days from the date of reception of the Products covered by the Sale and Purchase Agreements. The right of withdrawal must be exercised by Customers by sending Sve.zia S.r.l. a written communication by e-mail to firstname.lastname@example.org, containing the following information:
- The manifestation of the will to make use of the right of withdrawal;
- The indication of the Order that gave rise to the Purchase Contract from which they intend to withdraw.
- The reasons in detail of the request for return
9.2 In case of exercise by the Customers of the right of withdrawal under this art. 9:
I. The Customers undertake to return the Products within 10 working days from the date of the communication of withdrawal pursuant to clause 9.1;
II. All costs connected to the return of the Products are entirely charged to the Customers;
III. Sve.zia S.r.l. undertakes to refund the Price in the shortest time possible, and in any case within 30 days from the date of reception of the Products as per art. 9.2 on condition that:
o The Products have been returned and are intact;
o The original packaging/wrapping of the Products is also returned and is intact;
o The Products have not been used;
IV. Sve.zia S.r.l. will inform the Customers on the methods of refund of the Price and may, to this end, request the Customers’ bank details (IBAN and account holder).
9.3 Should the Customers exercise the right to withdraw in a way that does not comply with the terms and conditions set out in this article 9, the Customers will not be entitled to reimbursement of the Price.
10.1 Sve.zia S.r.l. guarantees that the products supplied are free from faults and defects that make them unsuitable for the use for which they are expressly intended.
The guarantee for manufacturing defects is limited only to those defects of the products that are attributable to defects in the material used or to design and construction problems attributable to Sve.zia S.r.l..
The guarantee does not cover defects due to normal wear of the products for parts subject to rapid and continuous wear.
10.2 The warranty from the moment of delivery will have a duration of 2 (two) years.
10.3 The above-mentioned guarantee is operative on condition that the products have been used and operated in compliance with and in accordance with the normal conditions of use and the instructions provided by Sve.zia Srl.
Sve.zia S.r.l. will be considered automatically deprived of the right to warranty in case of faults caused by imprudence, negligence, inexperience in the use of the supplied products, destination of the product to other use than the one contractually requested, or in case of tampering, modifications or alterations and in case the defects found are caused by external agents.
Sve.zia S.r.l. does not cover defects resulting from conditions beyond its control, including but not limited to improper use, overloading or failure to assemble, mount or use the product according to the indications/instructions of use written by Sve.zia S.r.l. or contrary to the safety notes, nor does it cover damage to the vehicle, electronic devices and the load of the user or owner.
10.4 The Purchaser shall report any defects in writing within and not later than 2 months from the delivery of the products, while the report of any hidden defects and/or operating defects shall be made within 2 months from the discovery of the defect and in any case not later than the warranty period. It remains firm that the action of guarantee is prescribed in any case in the term of 24 months from the delivery.
10.5 Complaints will have to be submitted by e-mail to email@example.com or by registered letter with return receipt to Sve.zia S.r.l., Viale Vittorio Veneto 4 – 23848 Ello LC, inserting the following information:
- Willingness to make use of the warranty;
- The defects or non-conformities found.
11. Product Liability and Limitations
11.1 Except for the fraud and gross negligence of the Producer/Supplier, the possible compensation of any damage to the Buyer will not exceed in any case the value of the single component of the Product and/or of the defective Product; in no case the Producer / Supplier is responsible for any loss of profit or loss of earnings, for any other type of economic damage, for indirect damages, consequential, arising from or in connection with the use, condition, possession, performance, maintenance, non-delivery or delayed delivery of the Products, even if the Producer / Supplier has been informed or has become aware of such damages.
11.2 The Producer/Supplier cannot be held responsible for damages deriving from the choice made by the Buyer of a particular use and/or employment of the Product and/or for events that occur, also in dependence of the supplied Product, in the exclusive sphere of the Buyer and/or on which the Supplier cannot exercise his control, or that, however, cannot be univocally ascribed to a direct and exclusive responsibility of the same Producer/Supplier for the lack of the promised qualities of the Product.
SVE.ZIA SRL declines any responsibility for any damage that may be caused, directly or indirectly, to people, things and animals due to the failure to comply with all the prescriptions indicated in the appropriate instruction booklet and safety notes especially concerning the warnings on the subject of installation, use and maintenance of the product.
12.1 Sve.zia S.r.l. declares and guarantees that the personal data of Customers will be treated in accordance with the provisions of Legislative Decree 196/03, and subsequent amendments.
13. Intellectual Property
13.1 All intellectual property rights connected to the online store (including its contents) are the exclusive property of Sve.zia S.r.l.; the online store and its contents may not be reproduced in whole or in part, transferred by electronic or conventional means, modified, linked and used for any purpose without the prior written consent of Sve.zia S.r.l.
14. Applicable law
14.1 The General Conditions and the Sale and Purchase Agreements are governed by Italian law (and in particular by Legislative Decree 206 of 06/09/2005 – which in articles 50 to 67 regulates distance contracts – and by Legislative Decree 70 of 09/04/2003 on electronic commerce) and must be interpreted in the light of this
